By visiting or using our Site, chatbot, or SMS services, you confirm that you have read and agreed to these Terms, as well as our Privacy Policy and our Notice of Privacy Practices (HIPAA).

2. Medical Information Notice

The Site and our AI chatbot provide administrative and informational assistance only. They do not diagnose medical conditions, provide treatment recommendations, or replace clinical judgment.

If you are experiencing a medical emergency, call 911 or visit the nearest emergency department immediately.

3. HIPAA & Protected Health Information

Protected Health Information: When you schedule appointments, use the chatbot, or communicate through our patient systems, some information may be considered Protected Health Information ("PHI") under HIPAA.

  • Compliance: We handle PHI in compliance with HIPAA.
  • Use of Data: PHI may be used for treatment, payment, and healthcare operations. This includes verifying identity, supporting scheduling, and coordinating care and services.
  • Communication Channels: We may use email or SMS to reach out to you regarding healthcare opportunities or services you might qualify for or be interested in.

4. Patient Text (SMS) Communication Program (10DLC-Compliant)

This section governs our texting system used for care coordination.

  • Purpose of Messages: Appointment reminders, identity verification codes (OTP), scheduling instructions, and care-related coordination messages.
  • Marketing Policy: We do not sell your data to third parties for marketing. We may send messages regarding your care and relevant health services provided by our group.
  • Message Frequency: Frequency varies based on your activity.
  • Opt-Out: Reply STOP to discontinue messages. You will receive confirmation.
  • Help: Reply HELP or call (713) 330-4325.
  • Carrier Disclaimer: This organization and mobile carriers are not responsible for delayed or undelivered messages.
  • Data Rates: Standard messaging and data rates may apply.

5. AI Chatbot ("Thaliya") and Online Scheduling

We are offering "Thaliya," an AI-powered virtual assistant, to assist with scheduling, rescheduling, canceling appointments, answering general clinic questions, or opening support requests.

  • Future Rollout: Thaliya is an evolving service; its capabilities will expand over time.
  • Data Handling: To perform these actions, the chatbot may request identifying details (PHI) such as name, date of birth, phone number, email, home address, or insurance details.
  • Privacy: Thaliya is HIPAA compliant. We have signed strict Business Associate Agreements (BAA) with our AI providers to ensure no information is used by third parties for model training or other purposes.
  • Identity Verification: Verification may require receiving a One-Time Password ("OTP") sent to your mobile number.

6. HIPAA-Compliant Ticket Handling

If you submit a patient support request through the Site or chatbot, authorized clinic staff may review the request and respond using the patient portal, secure message, phone, or email, depending on what is clinically appropriate and permitted under HIPAA.

7. No Payment Processing on This Website

This website does not collect or process any credit card, debit card, bank-account, or other payment information. All patient payments related to your medical care are currently completed exclusively through our third-party patient portal, PrognoCIS, which maintains its own security, compliance, and payment-processing standards.

Our organization may offer additional patient portals or applications that may require payment and may be operated directly by us. Any such service will be hosted on a separate website or application and will include its own dedicated terms of service, privacy policies, and payment disclosures governing the use of that specific system.

8. Intellectual Property Rights

All content on the Site (e.g., text, images, design, branding, and layout) is owned by Patricia H. Janki M.D., P.A. DBA ECare Medical Group and protected by law. You may not reproduce, alter, or distribute any content without written permission.

9. Privacy Policy Relationship

The Privacy Policy provides additional information regarding data collection, cookies, SMS handling, and security safeguards. Your use of the Site acknowledges acceptance of both the Terms and the Privacy Policy.
